미국 34개주 “애플 앱스토어 정책, 경쟁 저해”…에픽 지지

애플의 인앱(in-app) 결제 의무화 등 앱스토어 정책을 둘러싼 재판에서 미국 34개주와 워싱턴DC 주 정부가 애플 반대편을 지지하고 나섰다고 로이터통신이 27일(현지시간) 보도했다.

이들 주 법무장관들은 게임업체 에픽 게임즈가 제기한 애플 상대 반독점 소송 항소심이 열리는 제9 연방항소법원에 제출한 의견서에서 애플의 앱스토어 정책이 경쟁을 저해하고 있다며 반대 입장을 밝혔다.

이들은 인앱 결제를 의무화한 애플의 행위가 유해하고 이용자와 모바일 앱 개발자들에게 해를 끼치고 있다고 규정했다.

이어 애플이 앱 배포와 인앱 결제 솔루션을 지속해서 독점하면서 경쟁을 저해하고 있으며, 경쟁시장에서 기대할 수 있는 것보다 많은 수익을 챙기고 있다고 성토했다.

특히 해당 사건의 1심 법원이 찬반 의견을 판결에 적절하게 반영하지 못하고 애플이 경쟁 제한적인 관행을 이어갈 수 있도록 했다며 1심 판결에 이의를 제기했다.

이에 따라 시장 지배력을 가진 기업이 반독점 조사로부터 보호받는 역설적인 결과를 낳았다고 강하게 비난했다.

앞서 작년 9월 캘리포니아주 오클랜드 연방법원은 인앱 결제 의무화의 근거인 애플 자체 규정이 반경쟁적이라고 판단하면서도 애플이 모바일 게임 시장에서 독점 기업은 아니라며 10개 소송 쟁점 중 9개에서 애플의 손을 들어줬다.

그러면서 에픽 게임즈가 애플의 인앱 결제를 건너뛰고 이용자들이 에픽 게임즈에 직접 돈을 낼 수 있도록 자체 결제 시스템을 구축한 것은 애플과의 계약 위반이라며 자체 결제 시스템으로 얻은 판매액의 30%를 애플에 지급하도록 판결했다.

다만 “애플의 (결제 때 앱) 외부이동 차단(anti-steering) 조항이 소비자들에게 중요한 정보를 숨기고 불법적으로 소비자의 선택을 억압한다고 결론 내렸다”며 앱에 외부 결제용 링크를 허용하도록 했다.

에픽 게임즈는 1심 판결에 불복해 항소심 절차에 들어갔다.

애플도 1심 판결 직후 자사 제품을 쓰는 사용자에게 인앱 결제가 아닌 다른 방법으로도 앱을 구매할 수 있도록 하라는 법원 명령에 대해 집행정지 신청을 냈으나 기각됐다.

‘포트나이트’ 게임으로 유명한 에픽 게임즈는 자체 결제 시스템을 추진했다는 이유로 애플 앱스토어에서 퇴출당한 데 반발해 지난 2020년 8월 반독점 소송을 제기했다.

애플은 자사 제품 사용자에게 앱스토어를 통해서만 앱 관련 결제 기능을 이용할 수 있게 하고 결제액의 30%를 수수료로 가져가 과도한 이익을 챙긴다는 비판을 받아왔다.
