Healthcare professionals should be protected persons with a specific status under criminal law. Paramedics have long faced verbal attacks, threats, swearing, but also physical attacks. He pointed this out in an opinion from the Institute for Socio-Economic Risk Research. It calls on politicians to introduce the institution of a protected person into criminal law for all health professionals.
“Protected persons are rights. For this reason, the law regulates stricter punishment of perpetrators of crimes committed on a protected person. The protected person before the law uses the same protection as a public official. At the same time, health professionals perform their work in the public interest, but without the benefit of the protected person. This means that the offender could receive the same rate for attacking a protected person, in this case a medical professional, as he would receive, for example, for attacking a police officer, “explained Martin Halás, director of the institute.
The Institute for Research on Socio-Economic Risks also reminds that a protected person is, for example, a member of the National Council of the Slovak Republic, a witness, an expert, an interpreter, a translator and a sick person
The institute also points to a survey before the pandemic in the Czech Republic, which showed that up to 90 percent of health professionals in the Czech Republic were attacked by patients or their escorts. A similar study by Jessenius Faculty of Medicine, Comenius University in Martin among 1220 nurses from 2015 showed that the incidence of aggressive patient behavior in the Czech Republic and Slovakia is almost the same
Medical staff they encounter aggression mainly on urgent income.
According to the Institute for Research on Socio-Economic Risks, it is also necessary to reassess whether the current criminal law is sufficient. “For certain groups of protected persons, especially the elderly, children or loved ones, the state does not guarantee these protected persons a sufficiently effective, accessible and fast way of protection or punishment of the perpetrator,” Halás added.
