Court revokes preventive detention for Agro Nitrogenados

A unitary court ordered the release of the former director of Pemex, Emilio Lozoya, for the sale of the junk fertilizer plant Agro Nitrogenados, although the former official will continue in preventive detention for the investigation against him for his probable relationship in the plot of bribes from Odebrecht.

A unitary court ordered the release of the former director of Pemex, Emilio Lozoya, for the sale of the junk fertilizer plant Agro Nitrogenados, although the former official will continue in preventive detention for the investigation against him for his probable relationship in the plot of bribes from Odebrecht.

“A unitary court decided to withdraw the precautionary measure of preventive detention previously issued against Emilio ‘N’, former director of Pemex subject to trial for the irregular sale of the company Agro Nitrogenados ”, reported the Financial Intelligence Unit (FIU) of the Ministry of Finance, which is directed by Pablo Gómez.

The FIU added that as the offended party in the criminal proceedings for the case Agro Nitrogenados, filed an amparo lawsuit to review the constitutionality of said resolution. He also requested the suspension of its effects in order to avoid an obstruction in the continuity of the processes.

The Attorney General’s Office (FGR) implicated him for allegedly having ordered the purchase in 2013 of the unusable fertilizer plant with a surcharge of 500 million dollars to the company Altos Hornos de México (AHMSA), in exchange for bribes.

Odebrecht case

Lozoya will remain in prison because, for the Odebrecht case, he was also sentenced to preventive detention at the end of last year, a measure which was also challenged, according to what was reported at the time by the lawyer Miguel Ontiveros, who heads the defense of the former public official.

Lozoya was arrested in early 2020 in Spain and later extradited to Mexico. In August 2019, the former director of Pemex filed a complaint in which he accused former president Enrique Peña Nieto, Luis Videgaray, and other politicians of knowing about the Odebrecht bribery scheme.

Lozoya would have received about 10.5 million from said company so that it would benefit from government contracts. (With information from the Editorial Office)
