Quando o ministro do STF age contra a Constituição para ajudar o Itaú, fica difícil crer na justiça

Em 6 de outubro de 2020, o ministro Luiz Fux apresentou no Conselho Nacional de Justiça (CNJ), órgão que ele preside cumulativamente com o comando do Supremo Tribunal Federal, uma série de argumentos para tentar justificar uma aberração jurídica protagonizada por ele dias antes em um processo que tramita no Pará, e transitou em julgado. Seria apenas mais uma Reclamação Disciplinar, não fosse o fato do ministro, atuando na condição de Corregedor do CNJ, ter cassado a decisão da juíza Rosana Lúcia de Canelas Bastos.

O ineditismo da interferência, segundo Fux, se fazia necessário pois tratava-se de uma ação com valores ‘extravagantes’ e o ministro alegou que a juíza estava levantando os valores bloqueados ‘liminarmente’’ portanto, fazia-se necessária sua atuação, mesmo fora da competência do Conselho Nacional de Justiça. Fux levou informações erradas a seus pares, e mesmo que elas estivessem corretas, ele não poderia ter desrespeitado a Constituição e toda a jurisprudência do STF, para fazer o que fez.
