This Thursday (9/30), judge Fabiano Gonçalves Marques, from the 1st Civil Registry Office of Alvorada, in the State of Tocantins, sentenced Joidson Bezerra de Araújo, owner of the Hotel Vitória, located in the center of the city of Araguaçu (TO), to pay R$ 20 thousand to Ataniro de Paula Vieira Neto, 27, and Pedro Henrique Ferreira Dias, 22 years old, as compensation for pain and suffering. Ataniro and Pedro accuse the owner and his employee of the crime of homophobia, that is, of being prevented from staying at the aforementioned hotel.
The fact occurred in December 2019, in Araguaçu . Ataniro and Pedro, a homo-affective couple, inform in the records that they looked for the hotel to stay, paid the corresponding rate and even filled out the check-in form at the reception. When the attendant realized that this was not a straight couple, he even informed that the owner did not accept couples on the hotel premises that were not formed by a man and a woman, but even so he led them to one of the rooms of the establishment.
However, knowing about the accommodation, the owner refused to allow Ataniro and Pedro to stay at the hotel. The couple would have understood that the impossibility of settling in the place was due to the homo-affective relationship between the two , having, thus, communicated that they would leave the place and wanted the reversal of the daily rate already paid. It so happens that the hotel owner imposed the condition that they present a marriage certificate.
Police Report
According to the records, “the development of the facts culminated in the couple’s departure from the establishment and the defendant, owner of the hotel, arguing that the refusal to stay would be due to the fact that they were not married or have a marriage certificate to present, which, according to the defendant, would be a prerequisite for accommodation”. Ataniro alleges that he was pushed out of the hotel by the owner and then went to the police station to register the police report.
