In opinions to the STF, Aras is against points of the Social Security reform

BRASÍLIA (Reuters) – The Attorney General of the Republic, Augusto Aras, sent a series of opinions to the Supreme Court (STF) in which was against the points of the Social Security reform enacted by the National Congress in 2019, in the first year of the Jair Bolsonaro government.In four actions proposals by entities representing civil servants, Aras manifested himself against some points of the approved reform. This was the case of the new rules for pensions due to death, the increase in the contribution base imposed on retirees and the forecast of extraordinary contribution for civil servants.

“In the case of retirees and pensioners, the PGR’s understanding is that the expansion of the contribution base of retirees and pensioners of the own regime violates the principles of equality and human dignity by compromising the subsistence conditions of these categories, reducing excessive its purchasing power,” said the PGR in a statement. for civil servants, in case of deficit or serious imbalance in Social Security, in the next 20 years”, he added.

For the attorney general, this measure is reckless because it goes beyond the frontier of reasonableness and “assumes the contours of a ‘carte carte’ granted in favor of the ordinary legislator”. He considers that the adoption of a progressive table would be enough to reestablish and maintain the financial balance of Social Security, without the need for any extra contribution. Based on these arguments, the PGR opined on the partial granting of one of the actions.
