JusticeGopinathP,whilegrantingtherelieftoSyjuMThankachan,saidthatprimafacieandforthepurposeofconsideringhisentitlementtobail,theprovisionsofSection304(culpablehomicidenotamountingtomurder)maynotbeattractedevenifalltheallegationsagainsttheaccusedinteriordesignerweretrue.
Accordingtotheprosecution,investigationinthecasehasrevealedinstancesofvariousothercrimes,includingthoseunderNarcoticDrugsandPsychotropicSubstancesAct,committedbytheaccusedandtheCCTVvisuals,includingthoseoftrafficcameras,showthemannerinwhichhecausedtheaccident.
ThankachanwasarrestedinthecaseonNovember27,2021.AncyKabeer(25)andAnjanaShajan(24)haddiedinthefatalcrashonNovember1lastyear.Athirdpassenger,inthecar,succumbedtohisinjuriesafewdayslater.Thedriver,whoescapedwithinjuries,waslaterarrestedandisthefirstaccusedinthecase.
