Tesla on the dock: “Racism, hatred, swastikas“ “

Owen Diaz is used to a lot of things. For him as a black man in America, insults are part of everyday life. But what Diaz, judging by his allegations, experienced as a worker of Tesla, surpassed everything seen so far.

Diaz is 53 years old today, in 2015 and 2016 he worked in Fremont, California. In Tesla’s factory. There he was in charge of making metal parts for cars end up on a straight assembly line. But instead of a relaxed work atmosphere, he says, he was regularly exposed to unbearable situations – which bothered him so much that he eventually resigned. In the production halls, says Diaz, vile comments and messages of hatred were common, everyday occurrences.

Yesterday (September 29, 2021), exactly five years later, Diaz met his employer again. A former Tesla worker sued the company for racism and discrimination. Tesla’s factories are “a hotbed of racist behavior”, according to the indictment. The trial is taking place before a California court. According to the objection, black workers in Tesla are exposed to constant and serious harassment.

Nazis and KKK

Tesla denies these objections. In the “Diaz case”, the company has no knowledge of possible wrong behavior of its workers, it is claimed. At the same time, Tesla emphasizes that the company opposes all forms of discrimination, harassment and unfair treatment, and that every case is taken seriously – and that it is investigated: “We will never be able to prevent every single person in the factory from behaving inappropriately. but we will continue to do everything we can to encourage good behavior and take action if something bad happens. ”

Diaz is too little. He now demands compensation for his mental pain at the time. “You keep hearing sentences like, ‘Come here, nigger,’ or ‘Let’s go back to Africa,'” Diaz described his experiences in the New York Times in the fall of 2018: ? ” Racist drawings were also visible in the factory. There were swastikas and graffiti “KKK” on the walls in the toilets, which is an abbreviation for the Ku Klux Klan.

Not the first lawsuit

Diaz is not the only one who is suing Tesla for unbearable working conditions. Between 2018 and March 2021 alone, 120 people asked for the “right” to be able to sue Tesla for discrimination. Nine lawsuits were rejected due to lack of evidence, and all others were accepted.

The actual numbers are probably much higher. The reason for the limited number of lawsuits are the so-called arbitration statements that Tesla workers must sign when entering the workplace. In fact, they confirm that they will not “prosecute” their company in court in the event of a possible dispute. Diaz, like some other workers, were not directly employed by Tesla, but were formally workers of another company that “lent” them to Tesla. That is why he did not sign that agreement.

The most important thing – saving money

Tesla’s model is not an isolated case, it is a fairly common method for companies that are recording rapid growth and that do not pay much attention to the needs of their workers, experts say.

“Silicon Valley companies combine highly developed technologies with working relationships that are not in line with the spirit of the times and often come from 19th century, ”says labor historian Nelson Liechtenstein of California State University in Santa Barbara. He adds that companies like Tesla are trying to avoid legal, moral and social responsibility for their workers, but also to save money. “Even more important for them is that they can lay off workers whenever they want, that is, practicing exploitative production,” says Liechtenstein.

Aggressive and successful

Tesla in most cases reacts allergic to the accusations says Larry Orgen, Diaz’s lawyer, for the online magazine Protocol. First, everything is energetically discarded, then it moves into a frontal attack, he adds. In a blog from 2017, Tesla claims that Orgen has a “long successful balance of extortion for unfounded claims”, and adds: “We at Tesla would rather pay lawyers ten times more than the amount he asks for and we would rather fight to the very end than to allow us to be blackmailed and to allow such abuse of our judicial system ”. With his aggressive tactics, Tesla has had success so far. Of the nearly 90 labor law arbitration lawsuits filed between 2016 and early this year, the firm lost only one lawsuit. It was a case quite similar to Diaz’s.

Two months ago, a US court sentenced Tesla to a million-dollar fine – because, in his opinion, court, it has been proven that worker Melvin Barry has been exposed to racist insults from his bosses for years. A good part of that money went to cover court and lawyer’s costs, but $ 250,000 went to Beria – 100,000 of that as compensation for the mental pain he suffered.
