The Sofia City Administrative Court also rejected the appeal of A1 Bulgaria against the ban on the state to index monthly fees with inflation for two years. This was praised by the Deputy Prime Minister and Minister of Economy and Industry Cornelia Ninova.
The news comes after two days ago it became clear that the court rejected the appeal of Telenor Bulgaria. We remind you that even then Ninova spoke in the plural, when there was still only one decision issued .
Both companies appealed the order of the Commission for Protection consumers with different motives. A1 pointed out to the court that the regulator did not have sufficient reasons to allow the preliminary execution of the order due to “harm to the public and state interest.”
Telecom has the right to appeal the decision to the Supreme Administrative Court within seven days
Ninova did not fail to emphasize the heavy financial burden on consumers, who are currently paying significantly higher prices for energy and food, for example.
We remind you that the indexation of the monthly fees of the telecoms will lead to about BGN 1 increase, depending on the subscription plan. Ninova chose to fight against mobile operators who announced their intentions just before Christmas. Between the holidays, both pre-execution orders were issued, prohibiting A1 and Telenor from indexing prices in a different way than described in the general terms and conditions of the contracts.
The two companies intended to raise inflation fees for two years in total, although by law they are only allowed to do so on a one-year basis. Their competitor Vivacom chose to follow the generally accepted rules and avoided the wrath of the state. In case A1 and Telenor still decide to adopt the same method, they may increase the fees with the Consumer Price Index for 2021, which the NSI will publish soon.
