The president signed an amendment to the law on foreigners

On Tuesday, the president signed an amendment to the act on foreigners and some other acts, which is to facilitate the legalization of foreigners’ stay in Poland.

C the purpose of the Act is to streamline the procedures for granting foreigners temporary residence permits in the territory of the Republic of Poland, in particular temporary residence and work permits, which are the most frequently granted type of temporary residence permit in Poland.

The new regulations are also intended to improve other existing solutions in the case of foreigners, including the procedures for the admission of intra-corporate transferees. It is also proposed to shorten the time limits for examining applications for a national visa, i.e. optimize procedures and strive to shorten the duration of proceedings.

Another change is to accelerate the obtaining of a permit for foreigners who intend to work for entrepreneurs conducting activities of particular strategic importance for the Polish economy. Pursuant to the provisions of the amendment, the list of entrepreneurs by means of a regulation will be determined by the minister responsible for economy. When considering applications for a work permit, the voivode will take into account the priority of foreigners who are to work for entrepreneurs who will be on this list.

Amendment also assumes to facilitate the application for the Pole’s Card . After one of the changes among the evidence that can confirm the fulfillment of the conditions to receive this document, you will find the Card of the Pole of the applicant’s parent or one of the grandparents .

In addition, the amendment will introduce a provision to the act on repatriation, which will authorize the Council of Ministers to define in the regulation the administrative units included in the in the Asian part of the Russian Federation, whose residents may be issued with a national visa for the purpose of repatriation.

The regulation also provides for changes to the procedures for issuing a permit for seasonal work and declarations on entrusting work to a foreigner by extending the period of admissible work to 24 months.

: specifying a 60-day deadline for settling an administrative matter regarding granting a temporary residence permit to a foreigner new in the first instance, and a 90-day time limit for the case to be examined by the appeal body; shorten the time limits for processing applications for certain national visas, i.e. visas issued for the purpose of study, research or development work, internships or participation in the European Voluntary Service program – from 60 to 30 days; ordering the provisions on initiating the procedure for granting a temporary residence permit in cases where the application is not submitted in person by the foreigner who is to receive the permit;

Another of the changes concerns the introduction of regulations – as part of the procedures for granting residence permits – according to which the exchange of information between the voivode or the Head of the Office for Foreigners and the competent services and authorities providing information, whether the foreigner’s entry into the territory of the Republic of Poland and his stay there territory may pose a threat to the defense or security of the state or the protection of public safety and order, may be carried out by means of electronic communication.

The new regulations will start enter into force 14 days after the promulgation of the act. (PAP)
