Complication was provided by the prosecutor by amending the indictment
The complication occurred when on Tuesday, before the end of the trial, the prosecutor Matej Peterca slightly modified the indictment for the main protagonist Miloš Grm, who is otherwise accused of three criminal offenses of violence and causing grievous bodily harm. The prosecutor opted for such a maneuver because an expert hired at the request of the defense found that the serious bodily injury to Grm was caused by significantly reduced mental capacity, while the expert did not officially establish the situation for the violent crimes he had committed earlier. Prosecutor Peterc changed the indictment so that Miloš Grm also committed the criminal offenses of violence in a state of significantly reduced mental capacity, for which the Senate of Katarina Gabrijel Muhič did not find a basis in the case file. The judges therefore decided to resume the trial on February 11, and until then the expert will supplement the opinion on the defendant’s fitness at the time when he allegedly committed the crimes of violence.
