The Association of Accountants in Poland appeals to the Prime Minister to postpone the date of entry into force of the tax and contribution part of the Polish Deal by one year, i.e. until 2023. The organization points out that “the current situation of accountants is critical”. “Chaos ensued which hindered the work of accountants, who, under time pressure and in unstable conditions, have to apply solutions whose correctness they are not sure” – write the representatives of the association.
According to the Association of Accountants in Poland, the shift deadlines for the entry into force of the act “would make it possible to prepare a comprehensive revision of these regulations and to conduct public consultations.”
Polish Order. The accountants appeal to the prime minister
The organization also proposes alternative solutions if the government deems this demand impossible. One of them is the appointment by the Minister of Finance of a group of experts representing industry organizations, which will urgently prepare a comprehensive analysis and necessary changes to the provisions of the Polish Order. Another is the extension of the deadlines for the preparation and submission (submission) of: annual PIT-11, PIT-4R, PIT-8AR and CIT-8 declarations for 2021 and annual financial statements for 2021. The last solution suggested by accountants is the immediate publication of templates of tax returns annual for PIT / CIT taxpayers for 2021.
“Already in July 2021, in connection with the plans to introduce changes under the so-called Polish Order , The Association of Accountants in Poland called for: 1. to provide a sufficiently long period of vacatio legis, 2. to conduct broad public consultations, 3. to prepare practical guidelines enabling the correct application of the new regulations “- we read in the release.
“While pointing to the threats, we were not passive. Our organization raised many comments on the draft act introducing the so-called Polish Order. The implemented changes are of fundamental nature and affect the fiscal burden for most taxpayers. Their scope and haste the implementation has created a lot of confusion. Chaos has arisen, which hinders the work of accountants who, under time pressure and in unstable conditions, have to apply solutions that they are not sure of correct. This causes understandable frustration, especially since accountants and entrepreneurs, and not the regulator, are ultimately responsible for the correctness of settlements “- note the accountants.
Polish Governance “It would be the best form of apology”
The authors of the appeal to the prime minister emphasize that the accountants are first of all blamed by the person whose remuneration, through no fault of accountants, has decreased compared to 2021.
teachers, pensioners or officers of uniformed services have already received salaries or benefits in January and in some cases they turned out to be lower than the December ones. The most important information is here: All problems with the Polish Lada.
“The Association of Accountants in Poland is firmly against blaming accountants for the chaos related to the implementation of the so-called Polish Deal. Despite the symbolic period of vacatio legis, accountants intensively prepared for this change, devoting a lot of time to it, without neglecting numerous duties related to their current work “- they argue.
“We would like to emphasize that the current situation of accountants is critical. This is, inter alia, because the first errors in the so-called Polish Lada are corrected ad hoc. An example of such action is the issuance of the ordinance of January 7, 2022 on the extension of the deadlines for collection and transfer of advance payments for personal income tax by certain payers. This mode of operation, instead of dispelling doubts, additionally intensifies them. For example, it is not known how to proceed with PIT advances, e.g. in the event of a change of employer. Moreover, the IT systems are not adapted to the requirements of this regulation, “writes the organization.
Adds that accountants have many concerns about the application of this regulation.
“There is no doubt that there will be many more errors revealed in practice. Correcting them ad hoc is a bad solution. A comprehensive correction is needed. We count on a positive response to our appeal. This would be the best form of apology for words that blame accountants for the chaos associated with the so-called Polskie Ładem “- summarizes the Accountants Association in Poland.
Previously, it also brought together the largest organizations of entrepreneurs in Poland The Enterprise Council called on the government to suspend tax legislation Of the Polish Order by January 1, 2023 and for the restoration of the existing tax law regulations.
