Pasta Zara beats Zara. The Court of the European Union agreed with the Treviso-based pasta factory , in the legal battle against the Zara clothing brand of the Spanish giant Inditex , which intended to extend the well-known fashion brand to the world of restaurants and cafes. The verdict, after ten years of controversy, confirmed the previous decision of the European Union Intellectual Property Office ( EUIPO). The outcome was communicated by Bugnion , a leading company in Italy and Europe in consulting in Industrial and Intellectual Property (IP), first for the number of European patent filings, which it defended Ffauf Italia, the holding company to which the pasta factory belongs, and which will therefore be able to continue to use the Zara brand in the food sector (not only for pasta but also for related products, with the brand Le Delizie Zara) , registered as far back as 1969 in Italy and subsequently also in various countries of the European Union.

“Despite the tenacity and hatred of the counterpart – explains the Bugnion Legal team, made up of lawyers Paolo Creta, Benedetta Costa, Martina Lazzarotto, together with the consultant Marchi and Design Mauro Bronzini – we clearly demonstrated how the brand” Pasta Zara “was much earlier than the request made by Inditex, dating back to 2010”. Its roots in fact sinking into the 30s . It was the period when the grandfather of the 4 brothers who currently run the company decided to move his factory to Zadar, Croatia , to expand his business in the production of pasta – clarify the lawyers of Bugnion -. Later there was the civil war in Yugoslavia , which led to the closure of the plant and the return to Italy, until in the 1960s the top management decided to associate the name Zara precisely in memory of his grandfather and of that first factory built in Croatia ».
Zara’s other disputes
But Inditex’s legal actions don’t stop at the Zara pasta factory . In 2015 another dispute was initiated , still pending , this time against Bazzara, an artisanal coffee roaster in Trieste that exports coffee blends and is led by the Franco brothers and Mauro Bazzara. The reason is obvious: the name, which corresponds to the surname of the founders, is similar to that of the clothing chain. The operation was carried out despite the fact that the two companies operate in completely different sectors, are not competing with each other and communicate and promote different values and concepts. However, in the light of the recent ruling of the Court of the European Union in favor of the pasta factory, a glimmer of hope opens up for Bazzara herself . This is supported by the lawyer Andrea Piras, who has defended the roasting company since 2015. “This verdict – he specified – should lead to the automatic loss of the opposition that Zara has proposed against the Trieste company”.
