Vaccinated and hospitalized for adverse vaccinations will be able to apply for a compensation benefit without the need to refer to the lengthy court procedure – provided for in the act signed by President Andrzej Duda on Tuesday.
The amendment to the law on preventing and combating infections and infectious diseases provides for the creation of a compensation fund for people who are admitted to hospital due to adverse vaccine reactions (NOP).
Compensation benefit in the case of observation in a hospital emergency department or emergency room in connection with an anaphylactic shock is PLN 3,000. zloty. People who have been hospitalized for an anaphylactic shock for less than 14 days may receive £ 10,000. zloty. In the case of hospitalization (in six ranges) from 14 to more than 120 days, the benefit amounts to PLN 10,000. PLN up to 100 thousand. PLN – in proportion to the period of hospitalization.
The compensation benefit is additionally increased in the event of another event explicitly specified in the act, depending on its duration and type, by the amount from 5,000 PLN up to 20 thousand. zloty. The compensation benefit also covers the reimbursement of the costs of further treatment or rehabilitation after the completion of observation or hospitalization, in the amount not exceeding PLN 10,000. zloty. The regulation applies to reactions that occurred after vaccination against COVID-19 from the beginning of their implementation, as well as after compulsory vaccinations adopted from January 1, 2023 r.

The benefit will be obtained under the administrative procedure concluded with an administrative decision of the Patient’s Rights Ombudsman, after obtaining the opinion of the Fund’s Benefits Team as part of this procedure Compensatory Protective Vaccinations. The deadline for considering the application will be two months.
The decision issued by the Ombudsman will be subject to a complaint to the administrative court. Team members will be appointed for five years by the Patient’s Rights Ombudsman, and it will be composed of at least 6 specialists – doctors specializing in infectious diseases, paediatrics, allergology, neurology, surgery, cardiology and pulmonology, useful in the substantive assessment of applications.
Regardless of the benefit received under the Fund, the person who decides to file a claim for compensation or damages in connection with the occurrence of adverse effects after vaccination, will have the right to to assert one’s rights in court proceedings. (PAP)
